A. Use Of This Internet Web Site
By using this internet web site you agree to the following terms and conditions:
- Use Restrictions: Reproduction or modification of any information contained in this site is prohibited without the express written consent of Point Of Sale Warehouse. Point Of Sale Warehouse makes no representations that the information contained in this site is appropriate, available or permissible for use in all locations.
- Limitation Of Liability Disclaimer: In all circumstances Point Of Sale Warehouse's maximum
liability is limited to the purchase price of the products sold. Point Of Sale Warehouse shall
not, under any circumstances, be liable upon a claim or actions in contract,
tort, indemnity or contribution, or other claims related to the products it
sells which exceeds this liability limit. Point Of Sale Warehouse shall not be liable for third
party claims for damages against the User\Purchaser\Customer, or for malfunction, delays,
interruption of service, loss of business, loss or damage to exemplary
damages, whether or not Point Of Sale Warehouse is apprised of the possibility of such claims or
damages.
- Right To Change
Or Modify: Point Of Sale Warehouse reserves the right to change, modify and/or withdraw the
information, products or services in this site at any time without notice.
- Internet Web Site Accuracy While we make our best effort to keep the information on our internet web site site accurate, prices are subject to change without notice. In the event a price is found to be incorrect, or a product is not accurately depicted, we will make every attempt to contact the User\Purchaser\Customer to inform them of the changes. All information is believed to be accurate, but accuracy is not guaranteed.
- Governing Law
And Jurisdiction: The terms and conditions shall be governed by and construed in
accordance with the laws of the Province of Ontario. In the event of a
dispute between the user and Point Of Sale Warehouse and for all purposes in
connection herewith, the User\Purchaser\Customer consents to the
jurisdiction of the laws of the Province of Ontario.
- Severability: If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Ontario law.
- Entire Agreement: These terms and conditions, together with the Point Of Sale Warehouse invoice respecting the products ordered by User\Purchaser\Customer, are the complete and exclusive agreement between Point Of Sale Warehouse and User\Purchaser\Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Point Of Sale Warehouse and User\Purchaser\Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
- Copyright: All content included on this site is the property of Point Of Sale Warehouse or their content suppliers and protected by Canadian and international copyright laws. The compilation (meaning the collection, arrangement and assembly) of all content on this site is the exclusive property of Point Of Sale Warehouse and is protected by Canadian and international copyright laws. The content and software on this site may be used only as a shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this site is strictly prohibited.
- Right Of Refusal: Point Of Sale Warehouse reserves the right to limit quantities and to reject orders at upon its own and sole discretion.
B. Terms And Conditions Of Sale
- 1.5% per month (18% annual rate) charged on all past due amounts
- No returns accepted without Return Merchandise Authorization number ("RMA")
- Shipping charges, software and media products are not refundable
- User\Purchaser\Customer is responsible for shipping charges and risk of loss on all return shipments
- Returns of non-defective product are subject to a twenty-five percent (25%) restocking fee
- Refunds will not be issued after thirty (30) days from invoice date.
- User\Purchaser\Customer cancellations of booked orders prior to shipment, regardless of the reason, are subject to a ten percent (10%) administration fee at Point Of Sale Warehouse's sole discretion.
- New accounts are subject to a five ($5.00) administration fee.
C. Return Policies
Our goal is to ensure that you are completely satisfied with your
purchase. When you receive your package, we ask that you examine it
closely prior to opening the factory sealed product packaging. Please test your product as soon
as you receive it. If you are
not satisfied with your order, please email admin@pos-warehouse.com
and ask for a Return Merchandise Authorization (RMA) number. It will take
approximately 2 business days before an RMA is issued to you.
I. Helpful Hints to Ease the RMA Process:
- RMA's will not be issued after thirty (30) days from date of
order.
- Keep all original packaging as you received it for at least thirty
(30) days.
- Keep all products in new condition.
- Do not remove UPC codes or serial numbers. Boxes without UPC codes
or serial numbers will be refused.
- Do not write or mark the packaging, contents or warranty
registration cards.
- Products, whether defective or not, must be returned in the
manufacturer's original packaging and the carton must include all
components and other items originally packaged with the product:
cables, software, manuals, registration and warranty cards etc. Linked
promotional items must also be included. A ten percent (10%) re-box fee may
be charged on any box not returned in original unmarked condition.
II. General Returns Conditions - Applicable To All Returns:
- Shipping charges are not refundable.
- User\Purchaser\Customer is responsible for shipping charges and risk of loss on
all return shipments. Point Of Sale Warehouse highly recommends
using a reputable shipping carrier capable of providing proof of
delivery, as well as properly packing and fully insuring your return
shipment. We are not responsible for lost returns. For returns of
non-defective product, a twenty-five percent (25%) re-stocking fee may be
applied, at Point Of Sale Warehouse's
sole discretion.
- Refunds will not be issued after thirty (30) days
from date of order.
- Software and media products are not refundable.
- No returns will be accepted without prior authorization and a
Return Merchandise Authorization ("RMA") number. IMPORTANT: Products
returned without a valid RMA # appearing on the exterior packaging
will be refused.
- The "Ship To" address for RMA's may differ, depending on the product. Complete "Ship To" instructions, as appropriate, will be provided along with the RMA #, where applicable.
- All products (both defective and non-defective) must be returned
in original purchase condition, with the original packing material,
blank warranty cards, manuals and any other item or accessory provided
by the manufacturer. IMPORTANT: Returned orders with items missing
will result in rejection of the return or an additional restocking
fee, at Point Of Sale Warehouse's
sole discretion.
- IMPORTANT: Credit will not be issued on product(s) returned in non-resaleable condition.
- RMA numbers issued by Point Of Sale Warehouse are good for 10
days only, and product must be received by Point Of Sale Warehouse within that time.
RMA numbers cannot be extended or re-issued.
- Where a specific return period is applicable, no returns will be
accepted beyond that period.
- Refunds on purchases made with a credit card will only be credited
to the same card. The credit will be made within six weeks of receipt
and verification of the merchandise.
- User\Purchaser\Customer cancellations of booked orders prior to shipment, regardless of the reason, are subject to a ten percent (10%) administration fee at Point Of Sale Warehouse's sole discretion.
D. Warranty
All products sold by
Point Of Sale Warehouse come with the full and complete manufacturer's new product warranty.
Point Of Sale Warehouse does not sell refurbished or used equipment. Therefore, unless otherwise specified,
products purchased from Point Of Sale Warehouse are warranted by the manufacturer against defects in workmanship and materials
for a period of twelve (12) months from the date of shipment, provided that the product remains unmodified and is operated under normal
and proper conditions. Product warranties do, however, vary both by manufacturer and by product model.

Point Of Sale Warehouse is not the manufacturer of the products purchased by User\Purchaser\Customer and the only
warranties offered are those of the manufacturer, not Point Of Sale Warehouse.
